Terms & Conditions
About these terms
These terms apply to purchases from Evolve Bikes Pty Ltd and should be read together with our Warranty & Support, Returns & Refunds, Shipping & Delivery, Purchaser Responsibility and E-bike Laws & Rider Responsibilities information.
Product information
We aim to keep product descriptions, images, specifications and pricing accurate. Components, colours and details may vary between production runs where disclosed or where an equivalent specification is supplied.
Orders and pricing
Orders are subject to acceptance, product availability and successful payment. If a pricing, stock or listing error affects an order, we will contact you before proceeding.
Product use and rider responsibility
Customers are responsible for using, maintaining and operating their bicycle appropriately, within the model's stated specifications and intended use, and in accordance with laws and rules applying where the bicycle is ridden. Riders should perform reasonable pre-ride checks and arrange appropriate ongoing maintenance.
Damage caused or contributed to by misuse, accident or impact, excessive loading, inappropriate water exposure, corrosion, unauthorised modification or derestriction, incorrect assembly or repair, inadequate maintenance, normal wear or use outside the product's stated specifications is not treated as a manufacturing defect merely because it occurs during ownership.
Warranty claims and technical assessment
Evolve Bikes is the customer's point of contact for warranty claims. All claims should be submitted to Evolve so we can manage the process with the customer.
Where specialist expertise is required, Evolve may consult the bicycle manufacturer, supplier or relevant component manufacturer and may rely on their engineering, diagnostic or technical assessment as part of determining the cause of an issue and appropriate next steps. Evolve will continue to manage communication with the customer throughout the claim.
We may reasonably request photographs, video, error codes, odometer information, maintenance information, diagnostic testing, inspection, or return of an affected component or product where necessary to assess a claim.
Repairs, parts and remedies
The appropriate response to a reported issue depends on its cause, severity and the customer's rights under the Australian Consumer Law. Depending on the circumstances, this may include troubleshooting, repair, replacement of a component, replacement of a bicycle, or a refund where required by law.
Delivery
Delivery estimates are guides and can be affected by carriers, destination and circumstances outside our control. See Shipping & Delivery.
Australian Consumer Law
Our terms, policies and any manufacturer's warranty operate in addition to rights and remedies available under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
